Privacy Notice

Certain Sight’s Privacy Notice sets out how we collect and process your data when you use our services and website, please read this notice in conjunction with our terms & conditions, so that you can make an informed decision as to whether you want to consent to and comply with these policies.

The UK General Data Protection Regulations (UK GDPR) became effective on the 31st December 2020 and is tailored by the Data Protection Act 2018. The EU Exit Regulations applied technical amendments to make the GDPR work in a UK context, but the principles and rules are essentially unchanged. The Privacy and Electronic Communications (EC Directive) Regulations 2003 (PECR) is unchanged aside from references within it to the GDPR are now to the UK GDPR. It is possible due to changes in our operations or alterations to the law, that we may from time to time need to make changes to the privacy notice. This will be signified by a change to the date at the top of the notice. Please visit this page often so you are aware of any changes that have been made.

What data is being collected?

The data we collect depends on the service that you use, but generally is considered information that is personally identifiable, including but not limited to the following:

Name, Address, Email Address and Telephone Number(s).
Credit/Debit card info (collected by a 3rd party and stored on secure servers).
Date of birth and/or age.
Customer Comments that you have left for readers and given us permission to publish.
Complaints or communications by phone, by email or by post or via our website forms.
Telephone recordings.
Paper or computer documentation, that you have submitted or has been written by way of transposing a communication of some type.
Social media posting/comments/communications that you have left on or via our sites.

How do we use the data?

To provide, maintain and improve the Certain Sight brand, services and corresponding website.

To deliver Certain Sight services and provide/send to you any relevant information as required by that service.

We may contact you regarding a service that you have enquired about, purchased or requested.

We will respond to your comments, questions or requests by way of customer service across all platforms you may use.

If asked by a regulator we will comply with their requirements to provide data.

We may monitor calls to investigate any complaints.

We will investigate any fraudulent transactions or illegal activities and pass this information on to the appropriate company/authorities.

If you have consented to marketing we may send you our newsletter, updates about changes in legislation or delivery of our products, new or improved services we are offering and special offers.

Children’s Privacy:

Certain Sight do not provide services to anyone under the age of 18, and as such the website, social media, marketing and digital advertising has been structured as such to not attract anyone under that age.

Marketing:

If you have subscribed and consented to receive marketing materials by post or email through one of our websites or via our services, then you may be receiving communications from us concerning special offers, changes to our services or our newsletter by post or by email.

We want to ensure that it is as straightforward for you as possible to change your marketing preferences and unsubscribe should you wish to. So, if you wish to amend your address details, change from postal to email marketing or unsubscribe completely, the quickest way to do that is to email us providing the relevant information to: [email protected]

What is the legal basis for processing the data?

Contract: the processing is necessary for a contract you have with the individual, or because they have asked you to take specific steps before entering into a contract.

Will the data be shared with any third parties?

We want to reassure you that we take the processing and handling of your data very seriously. We do not and never will sell your data to a third party or allow any third party access to your data for marketing purposes.

We do use some external companies to assist in processing our services, and it may be necessary at times to share your data with them, for example, telecoms facilities, credit card processing, postal delivery, email distribution etc in order to provide you with the service you have requested.

Contractors such as email readers who are restricted to the information you have supplied to enable them to do the reading.

How long will the information be used/stored for?

We will only retain information or data for the length of time that is necessary for the purpose of our transaction with you and/or for the reasons set out in this privacy notice.

Clients may contact us, to ask ‘to be forgotten’, whereby we will delete contact details, call lists and card details for example. PSA requires that we retain call recordings for 36 months, we have adopted these timescales, as best practice across our business for all recordings; they are routinely deleted on a rolling basis. Certain aspects of your data will need to be retained on our systems, in case it is required in the future to query any billing or fraudulent event. Any information retained is for your/our protection, and this will be discussed with you, should you make such a request.

If you have opted-in to receive marketing materials from us, we will continue to send to you until such time as you change your preferences or unsubscribe, or we deem a suitable amount of time has passed since you last used our service and consider that you are no longer interested.

If you use our debit/credit card services via our Reception team then your card details will be stored for your convenience so you can use on future calls (you can request that they are not stored, at any time). The card will remain on the system until such time as the expiry dates have ended or you have not used the service in 6 months. Your card details are not stored by Certain Sight, they are processed by a third-party provider who is fully PCI compliant.
